This Privacy Policy describes how Motivision Group Inc. ("Motivision," "we," "us") collects, uses, and protects information in connection with the Motivision application and related services (the "Service"). It applies to coaches, administrators, and other account holders, and to athlete information processed through the Service.
Motivision provides training software to schools, teams, gyms, and other organizations. In most cases, your organization (for example a school or athletic program) decides what athlete information goes into the Service, and we process that information on the organization’s behalf. Where that is the case, the organization is responsible for obtaining consents and answering athletes’ and parents’ questions, and this policy describes what we do with the information once it is in the Service.
Account information. When a coach or administrator creates an account, we collect a name, email address, organization details, and role. Sign-in is passwordless; we send a code to your email to verify it.
Athlete and roster information. Organizations enter information about their athletes, such as names, team or group assignments, performance maxes, measurements, attendance, and related notes.
Training and performance data. The Service records data about workouts, including exercises, sets, reps, loads, and, where camera-based analysis is enabled, the Movement Data described in Section 3.
Video and Movement Data. Described in Section 3 below.
Payment information. If your organization purchases a paid plan, payment is processed by our payment processor. We receive plan, billing status, and transaction records, but we do not store full card numbers or bank account credentials.
Usage and device information. We collect standard technical information such as device type, operating system, app version, IP address, log data, and how the Service is used. We use this to operate, secure, and improve the Service.
If your organization’s subscription includes camera-based analysis, the Service uses a device camera to capture video of athletes performing exercises. Computer-vision technology processes this video to estimate body position and movement and to produce training metrics such as rep counts, velocity, tempo, and range of motion ("Movement Data").

We do not use athlete information to market to athletes, and we do not send marketing to athletes.
We may use aggregated and de-identified data to operate, evaluate, and improve the Service. Such data is stripped of names and other direct identifiers, is not used to identify any individual, and is not associated with your organization in any public disclosure.
Where the Service is used by schools and school districts:
Where the Service is used by an educational institution subject to FERPA, Motivision acts as a "school official" with a legitimate educational interest, uses education records only to provide the Service, remains under the institution’s direct control with respect to those records, and does not disclose them except as directed by the institution or as required by law.

We keep information for as long as needed to provide the Service to your organization. Organizations can edit or delete athlete records at any time, and deletion requests from athletes or parents should be directed to the organization, which can act on them in the Service or ask us to.
If a subscription ends or an organization’s account is closed, the organization has 30 days to export its data. After that period, we delete the organization’s data from our active systems, subject to residual copies in backups that are removed on our standard backup cycle and to any retention required by law.
We apply reasonable technical and organizational measures to protect information in the Service, including encryption in transit, access controls, and role-based permissions. No method of storage or transmission is completely secure, and we cannot guarantee absolute security. If we learn of a breach affecting your organization’s information, we will notify the organization as required by law.
The Service is designed for use by adult coaches and administrators. Athletes, including minors, do not create accounts; their information is entered and controlled by their organization, which is responsible for obtaining parental or guardian consent as described in our Terms of Service. If we learn that personal information about a minor has been collected without required consent, we will work with the organization to delete it, or delete it ourselves if the organization does not respond.
Depending on where you live, you may have rights under state privacy laws (such as the Texas Data Privacy and Security Act or the California Consumer Privacy Act) to access, correct, delete, or obtain a copy of your personal information.
For athlete information, we act on behalf of your organization, so we will refer requests about athlete data to the organization and support it in responding. For your own account information, contact us at support@motivision.ai and we will respond as required by law. We do not discriminate against anyone for exercising privacy rights.
Information in the Service is stored and processed in the United States. If you use the Service from outside the United States, you understand that information will be transferred to and processed in the United States.
We may update this Privacy Policy from time to time. If we make a material change, we will notify organizations through the Service or by email before the change takes effect, and update the effective date above.
