These Terms of Service ("Terms") are an agreement between you and Motivision Group Inc. ("Motivision," "we," "us"). They govern your use of the Motivision application and related services (the "Service"). Please read them carefully. By creating an account, accepting an invitation, or using the Service, you agree to these Terms. These Terms include an arbitration agreement and class action waiver in Section 16.
By creating an account, accepting an invitation to an organization, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
If you use the Service on behalf of a school, team, gym, or other organization, you represent that you are authorized to accept these Terms for that organization, and "you" includes that organization.
You must be at least 18 years old and legally able to enter into these Terms to use the Service as a coach or administrator.
You are responsible for your account and for keeping your sign-in method secure. You are responsible for all activity that happens under your account. Tell us promptly if you believe your account has been accessed without your permission.
Roles (such as admin, editor, and view-only) control what members of your organization can do. You are responsible for who you invite and the roles you assign.
You decide what athlete information you enter into the Service, for example names, performance maxes, measurements, attendance, and related notes. As between you and Motivision, your organization controls that information and is responsible for it; Motivision processes it on your behalf to provide the Service.
You represent and warrant that, for every athlete whose information is added to or collected through the Service, you have obtained all rights, permissions, and consents required by law and by your institution to collect, upload, store, and process that information, including any video capture and movement analysis described in Section 4. For any athlete under 18, this includes verifiable consent from a parent or legal guardian, and any authorization required by the athlete’s school, district, or institution.
You are responsible for the accuracy and lawfulness of the information you enter, for providing any privacy notices your athletes and their families are entitled to, and for handling requests from athletes or parents to access, correct, or delete their information. If a required consent is withdrawn, you are responsible for removing the affected information or asking us to do so.
Motivision applies reasonable technical and organizational measures to protect information in the Service, but no method of storage or transmission is completely secure, and we cannot guarantee absolute security.
If your Motivision subscription includes camera-based analysis features (such as automated rep counting, velocity-based training feedback, or movement analysis), the Service uses a device camera to capture video of athletes performing exercises. Computer-vision technology processes this video to estimate body position and movement and to produce training data such as rep counts, bar or body velocity, tempo, and range of motion ("Movement Data").
The Service does not use facial recognition and does not use video or Movement Data to identify individuals. Movement Data is associated with an athlete only through the roster information your organization maintains in the Service.
Video and Movement Data are collected, retained, and deleted as described in our Privacy Policy. You are responsible for ensuring that the consents described in Section 3 expressly cover video capture and movement analysis for every athlete who trains in view of a camera, and for positioning cameras so that only participating athletes are recorded.
Our Privacy Policy, available at https://motivision.ai/privacy, describes how we collect, use, and protect information in connection with the Service, and is incorporated into these Terms.
Where the Service is used by schools and school districts: we do not sell student personal information, we do not use student personal information to target advertising to students, and we do not build profiles of students for any purpose other than providing the Service to your organization.
Where the Service is used by an educational institution subject to the Family Educational Rights and Privacy Act (FERPA), Motivision acts as a "school official" with a legitimate educational interest under FERPA. We use education records only to provide the Service, remain under the institution’s direct control with respect to those records, and do not disclose them except as directed by the institution or as required by law.
The Service includes artificial-intelligence features that can generate training programs, suggestions, summaries, analyses, and other output ("AI Output").
AI Output is assistive and informational only. It is not professional, medical, physical-therapy, nutritional, or certified strength-and-conditioning advice, and it is not a substitute for your own professional judgment or for a qualified professional’s care.
AI Output can be inaccurate, incomplete, out of date, or inappropriate for a particular athlete. You are solely responsible for reviewing and verifying any AI Output and for every coaching decision, including the selection of exercises, loads, and progressions, warm-ups, technique, rest, and whether an athlete is healthy and cleared to train.
To the fullest extent permitted by law, Motivision is not responsible or liable for any AI Output or for any decision, result, injury, or damage arising from your use of it.
You agree to use the Service only for lawful purposes and in line with these Terms. You will not misuse the Service, interfere with its operation or security, attempt to access data you are not authorized to access, upload unlawful or infringing content, or use the Service to harm others.
You keep ownership of the information and content you put into the Service. You grant Motivision the permissions needed to host, process, and display that content in order to provide the Service to you and your organization.
We may also use aggregated and de-identified data to operate, secure, and improve the Service. Such data does not identify any individual and is not associated with your organization in any public disclosure.
Motivision and its licensors own the Service itself, meaning the software, design, models, and content we provide, and these Terms do not transfer any of those rights to you.
New organizations may receive a free period as shown at sign-up. After any free period, continued use may require a paid plan on the terms presented to you at that time.
Paid plans are billed in advance on a recurring basis (for example monthly or annually, as shown at purchase) and renew automatically at the end of each billing period unless cancelled before the renewal date. Before you are charged, we will present the price, billing frequency, and what the plan includes.
You can cancel at any time through your account settings or by contacting us at support@motivision.ai. Cancellation takes effect at the end of the current billing period. Except where required by law, fees already paid are non-refundable. We may change prices with notice; changes apply from your next renewal.
If your subscription ends or your organization’s account is closed, you will have 30 days to export your organization’s data from the Service. After that period, we may delete the organization’s data from our active systems, subject to residual copies in backups that are deleted on our standard backup cycle, and to any retention required by law.
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that it will meet your requirements.
To the fullest extent permitted by law, Motivision will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of the Service.
To the fullest extent permitted by law, Motivision will not be liable for any personal injury or physical harm to any athlete or other person arising from training, exercises, loads, or programming, including anything based on AI Output; responsibility for safe coaching and athlete welfare rests with you.
To the extent liability cannot be excluded, Motivision’s total liability arising out of or relating to the Service is limited to the amount you paid us for the Service in the twelve months before the event giving rise to the claim.
You agree to indemnify and hold harmless Motivision from claims, damages, and expenses (including reasonable legal fees) arising from your use of the Service, your content, your failure to obtain required athlete or parental consents (including consents covering video capture and movement analysis), or your breach of these Terms.
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or if we reasonably believe it is necessary to protect the Service, athletes, or others. Provisions that by their nature should survive termination, such as disclaimers, limitation of liability, indemnification, and dispute resolution, will survive.
Most concerns can be resolved quickly by contacting us at support@motivision.ai, and we ask that you do so first.
Any dispute arising out of or relating to these Terms or the Service that cannot be resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration will take place in Travis County, Texas, or another location the parties agree to, and may be conducted remotely. Judgment on the award may be entered in any court of competent jurisdiction.
You and Motivision each waive the right to a jury trial and the right to participate in a class action, class arbitration, or other representative proceeding. Disputes must be brought on an individual basis only.
Either party may bring an individual claim in small claims court instead of arbitration, and either party may seek injunctive relief in court to protect intellectual property or confidential information.
You may opt out of this arbitration agreement by emailing support@motivision.ai within 30 days of first accepting these Terms, stating your name, organization, and intent to opt out.
We may update these Terms from time to time. When we make a material change, we will update the version and ask you to review and accept the updated Terms before you continue using the Service. Your continued use after acceptance means you agree to the updated Terms.
If you believe content in the Service infringes your copyright, send a notice that complies with the Digital Millennium Copyright Act to our designated agent at support@motivision.ai with the subject "DMCA Notice." We will respond to valid notices, including by removing or disabling access to the identified material where appropriate.
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Subject to Section 16, any dispute not subject to arbitration will be brought exclusively in the state or federal courts located in Travis County, Texas.
